In Person Event

When: Thursday, October 22, 2026, 12:00 – 1:30 p.m. ET (doors open at 11:50 a.m.)
Where: Dirksen Senate Office Building, Room SD-106,

AI is rapidly changing how health information is generated, used, and shared, while many health privacy laws were designed for a different era. This briefing will give congressional staff a practical understanding of what health data is protected, which federal and state rules apply, who is responsible, and where gaps remain.

Speakers will connect the existing privacy frameworks to how AI is being used today, including emerging risks around inference, reidentification, and consumer health data, while also examining how state privacy and AI laws are evolving alongside federal protections and where those approaches intersect, diverge, or create complexity. The session will help staff understand why these issues matter for Congress and what questions to ask when evaluating emerging AI and privacy policy.

By the end of the briefing, congressional staff will be able to:

  • Explain the basic health data privacy landscape, including HIPAA, HITECH, other relevant federal authorities, and the growing role of state privacy and AI laws.
  • Define who has jurisdiction over what, including the respective roles of HHS, the FTC, Congress, and states, and why federal and state approaches do not always align.
  • Identify the new privacy considerations cascading from the use of AI in healthcare by patients, providers, and their business partners.
  • Distinguish between health information that is protected under existing law and health-related data that may fall outside traditional protections, including information generated through consumer technologies and AI tools.
  • Recognize how current AI capabilities are changing privacy risks, including inference, data aggregation, deidentification and reidentification, and secondary uses of health information.
  • Feel more confident engaging in AI and privacy conversations without needing to be a technical expert, and know where to turn for trusted information and expertise.
